3. SUPPLY AND
FIT
(a) Any dates of commencement and completion of works are offered in good
faith and are based on the position at the date of the order. They are
not guaranteed and could be subject to delays because of strikes, accidents,
government directions, force majeure, machine breakdowns, unavailability
of materials and parts and other causes beyond the Seller's control. The
Seller will make all reasonable endeavours to start and complete the works
by the dates given but will not accept liability for delays.
(b) In the case of Supply and Fit every endeavour will be made by the
Seller's surveyor to ensure that all existing work is good and sound before
the Seller accepts the work scheduled overleaf.
(c) The Seller will take all reasonable care to carry out the works without
causing damage to the Buyers premises but will not accept liability for
any redecorating. The contract price does not include repair or replacement
of any structural damage found during the course of carrying out the work
unless already included in the contract. Such additional work as necessary
will be settled by the Buyer direct to the Seller, on signing an additional
order.
(d) When making good necessary work, the Seller will endeavour to match
existing materials, i.e. brickwork, floors etc. but reserves the right
to substitute other materials.
(e) The Seller will undertake to make good plasterwork within the close
proximity of the window, providing that the existing plasterwork is keyed,
good and sound.
(f) Any defects attributed to bad workmanship or faulty materials supplied
by the Seller must be notified in writing by the Buyer to the Seller within
seven days of completion of the work and such defects will be investigated
by the Seller and if liability for the same is accepted will be rectified
by the Seller at the Seller's expense.
